1. Introduction
Greetings from EquitableCommonsLoop ("we," "our," or "us"). The following Terms & Conditions ("Terms") manage your engagement with our yacht charter services and the website at equitablecommonsloop.sbs (the "Service"), which is provided by EquitableCommonsLoop.
By reserving a yacht or using our Service, you consent to comply with these Terms. Should you object to any section of these terms, you are not permitted to use the Service.
2. Service Overview
EquitableCommonsLoop offers high-end yacht charter services that include, but are not limited to:
- Yacht charters by the day
- Evening boat trips
- Business retreats
- Exclusive events
- Extended yacht charters
Availability of all services is subject to change due to weather conditions. We hold the right to amend or halt services at any time without prior notice.
3. Booking and Reservations
3.1 Booking Process
To confirm a charter reservation, the following requirements must be met:
- Minimum age requirement of 18 years
- Submission of precise and thorough information
- Remittance of an initial payment as indicated in your booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
A charter is considered confirmed only after payment is received and we send a formal confirmation. The right to decline service rests solely with us.
3.3 Availability
Chartering is contingent upon the availability of vessels and favorable weather conditions. We will exert every effort to honor your requested dates and times.
4. Payment Terms
4.1 Pricing
All rates are quoted in € and are inclusive of taxes unless indicated otherwise. Prices are liable to modifications without prior announcement.
4.2 Payment Schedule
- Initial Payment: 50% of the full cost of the charter, payable during booking
- Final Payment: Due 48 hours before the departure of the charter
- Supplementary Charges (if applicable): Payable after completion of the charter
4.3 Payment Methods
Payment is accepted via major credit cards, direct bank transactions, and certified bank drafts. All payments are processed using secure and encrypted mechanisms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Canceling over 72 hours prior to departure: Entire amount refunded, minus any processing fees
- Canceling between 24 to 72 hours prior to departure: Refund of half the payment
- Canceling less than 24 hours prior to departure: No refund issued
5.2 Weather Cancellations
In cases where our captain deems the weather conditions as unsafe, we'll offer to:
- Reschedule the charter to an alternative date at no extra expense
- Issue a full refund in case rescheduling isn’t an option
5.3 Mechanical Issues
Should there be a mechanical failure with the reserved vessel, we'll make an effort to provide an appropriate replacement. If substitution isn't feasible, we'll provide a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Obey all instructions from the crew
- Utilize the safety equipment provided when necessary
- Notify of any medical conditions that could impact safety
- Stay within the assigned areas on the vessel
6.2 Prohibited Items
The following items are strictly forbidden aboard the vessel:
- Containers made of glass
- Contraband substances
- Weapons or firearms
- Non-alcoholic beverages beyond reasonable quantities for personal consumption
- Pets (unless with prior authorization)
6.3 Conduct
Guests are expected to act in a manner that is respectful at all times. A charter may be cut short without refund if a passenger's behavior is deemed to be dangerous or impeding the enjoyment of others.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the total amount paid for the charter. We are not liable for:
- Injuries caused by a passenger’s own neglect
- Theft or damage of personal belongings
- Indirect or punitive damages, or those following a consequence
- Delays provoked by weather or other factors outside our control
7.2 Insurance Coverage
All our vessels and activities maintain comprehensive marine insurance. It's recommended that passengers secure their own travel and personal insurance.
7.3 Assumption of Risk
By participating in our yacht services, you acknowledge the inherent risks involved with marine activities and accept personal responsibility for your safety and welfare.
8. Modifications and Itinerary Changes
We maintain the right to alter itineraries, routes, or schedules as needed based on meteorological conditions, safety needs, or operational demands. We will strive to provide a comparable alternative experience when changes are necessary.
9. Force Majeure
We are not accountable for any delays, cancellations, or changes brought about by events beyond our control, which include but are not limited to:
- Extreme weather conditions
- Natural catastrophes
- Regulations set by authorities
- Shutdowns of ports
- Technical breakdowns
10. Privacy and Data Protection
We address your personal information following our Privacy Policy. Utilizing our services equates to consenting to the gathering and utilization of your data as outlined in our Privacy Policy.
11. Intellectual Property
All content found on our website, including but not limited to text, visuals, trademarks, and pictures, is secured by copyright and trademark legislations. Unauthorized reproduction, distribution, or production of derivative works is prohibited without our explicit written consent.
12. Governing Law
The laws within France hold governance over these Terms. Any disagreements shall be resolved within the jurisdiction of courts situated in Antibes, France.
13. Changes to Terms
We hold the discretion to revise these Terms at any given moment. Updates will be made available on our website with a note of the revision date. Ongoing engagement with our services post-modification affirm your acceptance of the new terms.
